Joel Silver asking for kids to be left out of suit over death at Jennifer Aniston’s honeymoon party 

Producer Joel Silver does not want his offspring involved in a wrongful death lawsuit being brought forth by the family of his late personal assistant.

The family of Carmal Musgrove is suing over her death during actress Jennifer Aniston’s Bora Bora honeymoon party in 2015, and recently sent out subpoenas to people who were on the trip.

But Silver is asked a judge to leave his minor children, Samuel and Maxwell Silver, out of the proceedings, according to The Blast.

Silver contended that his children should not have to answer questions under oath seeing as they were only ’10 and 13 at the time of the drowning.’

The Lethal Weapon producer went on to say that the lawsuit was a ‘shakedown’ of a ‘truly frivolous’ nature and said that asking for his kid’s involvement is tantamount to harassment.

Meanwhile, Silver has offered himself and his wife to testify, but a judge has yet to rule on the matter.

The 28-year-old was naked when she was discovered in a private lagoon at the exclusive French Polynesian resort Four Seasons Bora Bora, where she was traveling as part of Silver entourage.

Musgrove’s San Diego based parents are suing Silver – the producer behind blockbusters such as The Matrix and Die Hard – as well as his production company and personal chef Martin Herold.

They claim Musgrove died because she was plied with booze and drugs by Silver and Herold.

Parents Ronnie and Ann Musgrove, who are prominent members of the Jehovah’s Witness community in Southern California, also say their daughter was overworked by 66-year-old Silver in the lead up to her death.

Musgrove started out as an intern for Silver Pictures and had been working there as an assistant for three years before her death.

Reports suggest that former couple Aniston and Theroux could be called as witnesses when the trial finally begins, although a representative for the actress insists that she has nothing to do with the case.

Musgrove spent from August 4 to August 19 at the Bora Bora Four Seasons resort for her work with Silver, a close friend of the couple.

It is alleged Musgrove was involved in an ongoing sexual relationship with Herold and he was one of the last people to see her alive.

The day before she died, she went on a fishing trip followed by lunch and dinner with the Silver family.

The Musgroves’ lawsuit claims that during this time Silver, who maintains that he is not responsible for his assistant’s death, ‘furnished Carmel with alcohol’.

That night Musgrove and Herold exchanged messages of a ‘flirtatious nature’.

She visited him in his bungalow where he allegedly gave her more alcohol, marijuana and cocaine.

Key swipe records show that she went back to her room at 11.11pm and around midnight she requested matches from the hotel’s front desk.

The delivery of the matches was the last time anyone reported seeing Musgrove alive, the suit says.

The alarm was raised the following day after she appeared to be missing.

After more than a day’s search Musgrove’s body was found ‘floating nude on one of the banks in a nearby lagoon’.

Toxicology tests confirmed there was alcohol, marijuana and cocaine in her system.

A French investigation found her death was the result of overconsumption of alcohol, consumption of cocaine, fatigue caused by overwork, heat stroke after the fishing trip and a midnight swim during unfavorable weather conditions.

The Musgroves’ lawsuit claims the first four factors are ‘traceable to conduct involving defendants.’
